Gym Tek Terms and Conditions

1. Acceptance of terms

By using the Service, creating an account or subscribing, you agree to be bound by these Terms and the Privacy Policy. If you do not agree, do not use the Service.

2. Definitions

• "Provider" or "we": BarmajTek.
• "Service": the Gym Tek website, platform, applications and the support BarmajTek provides.
• "Customer", "gym" or "you": the person or organisation subscribing to the Service.
• "End users": the gym's members and staff whose data is managed through the platform.
• "Gym Tek subscription": the plan and term agreed in exchange for fees the gym pays BarmajTek.

3. Service description

Gym Tek is software as a service for running gyms, covering memberships, check-in by QR code and at the front desk, classes, personal training and workout plans, invoices and reports. WhatsApp messages are sent only after the gym connects its account, and CliQ payment codes appear on invoices.

The Service does not include gate or door hardware unless agreed in writing. We may develop or change features and will give notice of any material change in advance.

4. Eligibility and accounts

• You must be legally able to contract, provide accurate and current information, and confirm your email address before creating the gym.
• You are responsible for keeping sign-in details confidential and for all activity under your account and your staff accounts.
• You must notify us immediately of any unauthorised use of your account.

5. Plans and free trial

• Gym Tek is offered in monthly, annual and gym-chain plans, at the prices published on the plans page when you subscribe.
• A plan starts with a free trial for the length shown when you subscribe, with no bank card.
• The trial does not turn into a paid subscription automatically. If it ends unpaid, access to the gym tools stops and the data is kept until the subscription is activated.

6. Pricing, billing and payment

• All prices are in Jordanian dinars unless stated otherwise.
• The Gym Tek subscription is paid in advance by CliQ or bank transfer and is activated once the payment is confirmed.
• The subscription renews when the next period is paid. If it is not paid, the platform allows a short grace period and then suspends access until payment, with the data kept.
• We may change prices with prior notice, effective from the next period.

7. Taxes and official invoicing

Prices exclude general sales tax unless stated. Once we are registered for sales tax, tax is added at the legal rate and the official invoice is issued through the national JoFotara system as the Income and Sales Tax Department requires.

8. Gym obligations and acceptable use

• Use the Service only for lawful purposes and in line with Jordanian law.
• Do not resell or sublicense the Service without written permission.
• Obtain members' consent to the processing of their data, and to receiving WhatsApp messages before enabling them.
• Keep the member, membership and payment data the gym enters accurate.

9. Data ownership

The gym's data, including its members' and staff data, remains the gym's property, and we process it only on the gym's instructions. We notify the gym without undue delay of any breach affecting its data once we become aware of it, and delete or return its data at the end of the contract on its request.

10. Intellectual property

The Service, its software, interfaces and trademarks (BarmajTek and Gym Tek) remain the Provider's exclusive property. These Terms grant you a limited, non-exclusive, non-transferable right of use and transfer no ownership.

11. Availability and support

We aim for continuous availability, with scheduled maintenance when needed. For support, email support@barmajtek.com.

12. Third-party services

The Service may rely on external providers such as WhatsApp, CliQ, banks, hosting, email providers and JoFotara. We are not liable for interruptions or changes to these services beyond our control, and their use is subject to their providers' terms.

13. Suspension and termination

• We may suspend or terminate the account for a material breach, such as unlawful use, a security threat or non-payment.
• You may end your subscription at any time by not renewing it or by written notice.
• On termination, usage rights end, and clauses that by their nature survive remain in effect, such as intellectual property, confidentiality and limitation of liability.

14. Refunds and cancellation

You can stop your Gym Tek subscription at any time by not renewing it. Refund requests for a period that has started are handled by written agreement with us, so contact us about them.

15. Disclaimer of warranties

The Service is provided "as is" and "as available", and we do not warrant that it is entirely error-free or fit for a particular purpose. The platform is an administrative tool, and its workout plans and measurements are organisational tools, not a substitute for a qualified trainer or a doctor.

16. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect or consequential damages, lost profits or lost data. Our total liability shall not exceed the fees the gym paid in the twelve months before the event giving rise to the claim.

17. Indemnity

The gym agrees to indemnify the Provider against any claims or damages arising from its breach of these Terms or the law, its infringement of third-party rights, or its unlawful use of the Service.

18. Confidentiality and data protection

Both parties keep exchanged information confidential. Personal data is processed under the Privacy Policy and the Personal Data Protection Law No. (24) of 2023.

19. Changes to terms

We may update these Terms from time to time. We publish the new version with an updated date and notify you of material changes before they take effect.

20. Force majeure

Neither party is liable for a breach caused by circumstances beyond its reasonable control, such as natural disasters, communications or power outages, government decisions, war, or infrastructure provider failures.

21. Governing law and jurisdiction

These Terms are governed by and construed under the laws of the Hashemite Kingdom of Jordan. Any dispute will first be addressed amicably; failing that, the courts of Amman have jurisdiction.

22. Notices and general provisions

• Official notices are sent to info@barmajtek.com or within the platform.
• If a clause is invalid, the remaining clauses stay in effect.
• Not exercising a right is not a waiver of it.
• These Terms and the Privacy Policy form the entire agreement between the parties.
